These Terms & Conditions (“Terms”) govern your use of the website perealestatesolutions.com/peconstruction/ and your agreement with PE Construction for providing construction, renovation, and contracting services. By accessing the website, submitting requests for quotes, or engaging our services, you agree to abide by these Terms.

Services

PE Construction offers general contracting, renovation, interior & exterior finishing, additions, remodels, and related services in the Windsor-Essex & Chatham-Kent region. Scope of services will be defined in the contract or quote provided to you.

Quotations & Contracts

  • All quotes/estimates provided are based on the information you supply. If the project scope changes, additional costs or time may be required.
  • A written contract or service agreement will be provided before work commences, detailing scope, materials, timeline, payment schedule, warranties, and any change-order process.

Payment Terms

  • A deposit is required prior to commencement of works (amount to be specified in contract)
  • Progress payments will be tied to project milestones (e.g. site prep, rough-in, finishing, etc.)
  • Final payment is due upon completion, final walkthrough, and client satisfaction
  • Payment methods accepted will be specified in the agreement

Timeline & Schedule

  • The timeline in your contract is an estimate based on current information and conditions. Delays may occur due to weather, permit approvals, material availability, or unforeseen site conditions.
  • We will make reasonable efforts to communicate delays or required changes in schedule.

Change Orders

  • Any changes to the original scope must be requested in writing via a “change order.”
  • Change orders may affect cost and schedule. We will provide you with cost and time estimates for the changes before implementing them.

Warranty & Guarantee

  • We warrant that work will be performed in a professional manner and in accordance with applicable building codes and standards.
  • Materials installed will carry manufacturer warranties where applicable.
  • If defects related to workmanship occur within the warranty period (as specified in your contract), we will repair defects at no cost. Warranty does not cover damage due to misuse, neglect, acts of nature, or modifications by others.

Permits, Codes & Regulations

  • You (the client) are responsible for ensuring you own the property and have legal authority to make required modifications.
  • PE Construction will assist in acquiring required permits and ensuring work complies with local building codes, zoning laws, safety regulations.
  • Client shall provide access and information needed for permit applications.

Liability & Insurance

  • PE Construction shall maintain general liability insurance and any other required insurance (workers compensation, etc.) as required by law.
  • We are not liable for delays or damage arising from causes beyond our control: acts of God, weather, labour shortages, supply chain disruptions, unforeseen site conditions.
  • Our liability is limited to the total amount paid under the contract.

Client Responsibilities

  • Provide accurate information about project, access to site, utilities, etc.
  • Ensure site is safe and accessible; protect valuables, furniture, etc.
  • Make timely decisions regarding finishes or materials so as not to delay work

Cancellation & Termination

  • Either party may terminate the contract in writing under specified conditions (e.g. breach of contract, non-payment, or other agreed-upon conditions).
  • If you terminate, you may be responsible for payment of work done up to termination date, materials ordered, and reasonable costs incurred.

Intellectual Property & Use of Website

  • All content on the website (text, images, logos, graphics) is owned by or licensed to PE Construction. You may not use them without permission.
  • Use of our name, logo, portfolio images in your own marketing or reproduction requires written permission.

Dispute Resolution & Governing Law

  • These Terms are governed by the laws of the Province of Ontario and applicable Canadian federal laws.
  • Any disputes arising under or in connection with these Terms or services will first be attempted to be resolved by negotiation / mediation. If that fails, parties may pursue other available legal remedies.

Limitation of Liability

  • To the maximum extent permitted by law, PE Construction shall not be liable for indirect, incidental, special or consequential damages, loss of profit or anticipated savings, or loss of data or materials, even if advised of the possibility.
  • Our total liability under any service contract shall not exceed the total fees paid by you under that contract.

Severability & Entire Agreement

  • If any provision of these Terms is found to be invalid or unenforceable, it will be severed and the remainder of the Terms will continue in full force.
  • These Terms plus the written service contract/quote represent the entire agreement between you and PE Construction regarding services, superseding any prior understandings or agreements.

Changes to Terms & Conditions

We reserve the right to modify or update these Terms at any time. Updated Terms will be posted on this page with the effective date. Your continued use of the website or engagement in our services after changes are posted constitutes your acceptance of those changes.
